These Terms and Conditions (“Terms”) govern your use of the HelixCura Hospital Management System (“Platform”), operated by Swastham Heart Care Private Limited, located at 1st floor, 1-B, Pulse Doctor House, Beside Venus Hospital, Lal Darwaja, Surat – 395003, Gujarat, India.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HelixCura regarding your use of the Platform.

Acceptance of Terms

Agreement to Terms

By accessing, registering for, or using the HelixCura Hospital Management System (“Platform”), you (“User”, “Healthcare Provider”, or “Authorised Personnel”) agree to be bound by these Terms and Conditions. These Terms apply to all users including hospital administrators, doctors, nurses, support staff, and patients accessing the Platform.

Eligibility

Use of HelixCura is intended for registered healthcare facilities and their authorised personnel. Individual patient access is provided through the facility using HelixCura. You must be at least 18 years of age, or have obtained parental/guardian consent, to use this Platform.

Description of Services

Platform Overview

HelixCura provides a comprehensive Hospital Management System that includes appointment scheduling, patient registration and record management, electronic medical records (EMR), billing and invoicing, clinical workflow management, staff and doctor management, and reporting tools — delivered through a secure web-based platform.

Service Availability

We strive to maintain 99.9% platform uptime. However, scheduled maintenance windows, technical upgrades, or unforeseen circumstances may occasionally affect availability. We will provide advance notice where possible and work to minimise disruption to healthcare operations.

No Medical Advice

HelixCura is a healthcare management and administrative tool. The Platform does not provide medical advice, diagnosis, or treatment recommendations. All clinical decisions remain the sole responsibility of qualified and licensed healthcare professionals. HelixCura is a tool to support healthcare operations, not a substitute for professional medical judgement.

User Obligations & Responsibilities

Authorised Use Only

You agree to use HelixCura solely for its intended purpose of healthcare management within your registered facility. Unauthorised access, data scraping, reverse engineering, or use of the Platform for any illegal or unethical purpose is strictly prohibited.

Account Security

You are responsible for maintaining the confidentiality of your login credentials. You must immediately notify us at info@swasthamheartcare.com if you suspect any unauthorised access to your account. HelixCura will not be held liable for any loss or damage resulting from failure to maintain account security.

Data Accuracy

Healthcare providers and staff are responsible for ensuring the accuracy of patient records, medical histories, appointment data, and all information entered into the Platform. HelixCura cannot guarantee the accuracy of data input by users and shall not be held liable for errors arising from incorrect data entry.

Patient Consent

Healthcare facilities using HelixCura are responsible for obtaining valid and informed consent from patients before collecting, storing, or sharing their personal and medical information through the Platform.

Compliance with Laws

You agree to use HelixCura in full compliance with all applicable laws and regulations, including but not limited to the Information Technology Act 2000, the Digital Personal Data Protection Act 2023 (India), applicable state medical regulations, and any other relevant healthcare data privacy laws.

Prohibited Activities

You Must Not

Use the Platform to engage in any unlawful activity; share or disclose patient data to unauthorised parties; attempt to gain unauthorised access to any part of the system; upload malicious software, viruses, or harmful code; misrepresent your identity or credentials; use automated bots or scripts to access the Platform; circumvent security measures or authentication systems; share your access credentials with unauthorised individuals.

Consequences of Violation

Violation of these prohibitions may result in immediate suspension or termination of access to HelixCura, legal action under applicable Indian laws, and reporting to relevant regulatory authorities. We reserve the right to take all necessary legal steps to protect the Platform and its users.

Data Privacy & Communications

Data Handling

The collection, storage, and use of personal and medical data through HelixCura is governed by our Privacy Policy, which forms an integral part of these Terms and Conditions. By using HelixCura, you also agree to the terms of our Privacy Policy.

Patient Communication Responsibility

Healthcare facilities are solely responsible for the content, accuracy, and appropriateness of communications sent to patients through the HelixCura Platform. Patients may opt out of automated communications at any time.

Limitation of Liability

Platform Limitations

HelixCura is provided on an ‘as is’ and ‘as available’ basis. While we strive to maintain a reliable and secure platform, we do not guarantee uninterrupted or error-free service. To the maximum extent permitted by law, HelixCura and Swastham Heart Care Private Limited shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use or inability to use the Platform.

Medical Decisions

HelixCura expressly disclaims all liability for clinical decisions, medical treatments, diagnoses, or health outcomes. All medical decisions remain the exclusive responsibility of qualified, licensed healthcare professionals using the Platform.

Third-Party Services

HelixCura may integrate with third-party services to support platform operations. We are not responsible for the availability, performance, or policies of third-party services. Any issues arising from third-party integrations should be directed to the respective service providers.

Maximum Liability

In no event shall HelixCura's total cumulative liability to a healthcare facility exceed the total fees paid by that facility to HelixCura in the three (3) months preceding the event giving rise to the claim.

Intellectual Property

Ownership

All content, design, software, code, branding, logos, and materials on the HelixCura Platform are the exclusive intellectual property of Swastham Heart Care Private Limited and are protected under applicable Indian and international intellectual property laws.

Limited Licence

HelixCura grants you a limited, non-exclusive, non-transferable, revocable licence to use the Platform solely for your healthcare management operations. You may not copy, modify, distribute, sell, or create derivative works based on HelixCura's intellectual property without prior written consent.

User Content

Healthcare facilities retain ownership of patient data and records entered into the Platform. By using HelixCura, you grant us a limited licence to process and store this data solely for the purpose of providing the services described in these Terms.

Termination & Suspension

Termination by User

Healthcare facilities may discontinue use of HelixCura at any time by providing written notice to info@swasthamheartcare.com. Upon termination, we will provide a transition period for data export in accordance with your service agreement.

Termination by HelixCura

We reserve the right to suspend or terminate access to the Platform immediately if a user violates these Terms and Conditions, engages in fraudulent activity, fails to make payment, or if required by applicable law.

Data Post-Termination

Upon termination, we will retain your data for a period as specified in your service agreement or as required by applicable medical record retention laws, after which it will be securely deleted or returned as mutually agreed.

Governing Law & Dispute Resolution

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. The courts of Surat, Gujarat, India, shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

Dispute Resolution

In the event of any dispute, the parties agree to first attempt to resolve the matter through good faith negotiation. If resolution cannot be reached within 30 days, the dispute may be escalated to arbitration under the Arbitration and Conciliation Act, 1996 (India) with a single arbitrator seated in Surat, Gujarat.

Changes to These Terms

HelixCura reserves the right to update or modify these Terms and Conditions at any time. Material changes will be communicated via email or a prominent notice on the Platform. The updated Terms will be effective from the date of publication.

Your continued use of the Platform after any changes are made constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
